Today I raise our defiant,  tattered flag for Uber, a company that constantly operates under the threat of  fines and closure all over the world.   Their crime?  A brazen attempt to  deliver you better service at a lower cost than the existing taxi syndicates.<\/p>\n<p> The latest case is in Germany. <em>The Wall Street Journal <\/em>reports that a  German regional court has imposed a national ban on Uber\u2019s second tier level of  service \u2018Uberpop\u2019. Uberpop is a way for regular drivers and passengers to  connect via their smartphones to get around. Uber runs the risk of a \u20ac250,000  fine if it continues to operate it while the ban is in place. Talk about the  ride of your life. <\/p>\n<p> Here\u2019s the key bit:<\/p>\n<blockquote>\n<p>\u2018<em>The suit against Uber in Germany was brought  by Taxi Deutschland, a consortium of taxi companies operating in major cities  across Germany. &#8220;The Passenger Transport Act regulates the protection of  drivers and consumers. That can&#8217;t easily be overturned no matter how neoliberal  the company,&#8221; Dieter Schlenker, chairman of Taxi Deutschland, said in a  statement.<\/em>\u2019<\/p>\n<\/blockquote>\n<p> Uber is fighting these kinds of  cases all over the world. It\u2019s the kind of disruptive business Austrian  economist Schumpeter liked to call \u2018creative destruction\u2019. These winds like to  blow the established house of cards down. But there\u2019s a big problem, at least as  far as government is concerned.<\/p>\n<p> No doubt the companies connected with  Taxi Deutschland \u2014 like everywhere else \u2014 paid for expensive licenses from the government  to operate. These companies now demand that the government protect what they paid  for. The result? Enter the judges and the goons; competition and the consumer\u2019s  best interests be damned. The big banks and hedge  funds are hoovering up what\u2019s left of the <a href=\"http:\/\/www.moneymorning.com.au\/property-market\" title=\"more on the property market\"><strong>cheap property<\/strong><\/a> in the former economic  blast zones of the real estate-led collapse in 2008. Having said that, it\u2019s not  something I went on the record with a few years ago. Colleague Phil Anderson  did. <a rel=\"nofollow\" href=\"http:\/\/pro1.portphillippublishing.com.au\/256785\/\">You  can see why here<\/a>.    <\/p>\n<p> Spanish real estate \u2014 down 40% from  the 2007 peak \u2014 is suddenly the hot favourite. <em>Bloomberg <\/em>reported last week that Spain\u2019s largest IPO in three  years just raised \u20ac1.25 billion and within a week spent \u20ac740 million to buy  commercial property.  <\/p>\n<p>Not only that, but this fromBloomberg<em>: <\/em><\/p>\n<blockquote>\n<p>\u2018<em>Merlin\u2019s IPO capped a dizzying six months of  Spanish real estate deals. In January, the New York\u2013based private-equity firm  Apollo Global Management LLC bought the real estate unit of Banco Santander SA,  Spain\u2019s biggest bank by assets, for 664 million euros. In March, the  Madrid-based REIT Hispania Activos Inmobiliarios SA raised 500 million euros  from investors, including George Soros\u2019s Quantum Strategic Partners LP and John  Paulson\u2019s Paulson &amp; Co. In June, Texas-based private-equity firm Lone Star  Funds and JPMorgan Chase &amp; Co. bought a 4.4 billion euro portfolio of  Spanish and Portuguese commercial property loans from Commerzbank AG of  Frankfurt.<\/em>\u2019<\/p>\n<\/blockquote>\n<p> This is similar to Blackstone Group\u2019s  playbook. In recent years, they\u2019ve bought up distressed residential real estate  in the US, spending over $8 billion playing the US property rebound. <\/p>\n<p> Now Chinese developers are moving further  into the American property market. And according to the <em>Wall Street Journal<\/em> this week, they\u2019re not there to buy up old  properties, but to build new ones. With China\u2019s property market cooling off, they\u2019re  looking to expand their business in the US. <a rel=\"nofollow\" href=\"http:\/\/pro1.portphillippublishing.com.au\/256785\/\" target=\"_blank\">All this behaviour is perfectly in  accord with the predicted movement of the real estate cycle<\/a>. <\/p>\n<p>   Of course,  <a href=\"http:\/\/www.moneymorning.com.au\/category\/property-market\/australian-housing\" title=\"more on Australian Housing\"><strong>real estate<\/strong><\/a> moves in long trends and time frames. Here in Australia, the <a href=\"http:\/\/www.moneymorning.com.au\/category\/financial-system\/banks-and-interest-rates\/reserve-bank-of-australia\" title=\"more on the Reserve Bank of Australia\">Reserve Bank of Australia<\/a> released its latest chart pack this week. You can see most of the \u2018boom\u2019 action  has been in Sydney and Melbourne. <\/p>\n<div align=\"center\"><a rel=\"nofollow\" href=\"\/\/www.portphillippublishing.com.au\/images\/DRW20140905a-lgr.jpg', 'Tracking', 0, 0) %]\" target=\"_blank\"><img decoding=\"async\" class=\"expander\" src=\"http:\/\/www.portphillippublishing.com.au\/images\/DRW20140905a-sml.jpg\" alt=\"Real Estate Housing Prices\" border=\"0\" \/><\/a><br \/>\n<a rel=\"nofollow\" href=\"\/\/www.portphillippublishing.com.au\/images\/DRW20140905a-lgr.jpg', 'Click to enlarge', 'Tracking', 0, 0) %]\" target=\"_blank\"><em>Click to enlarge<\/em><\/a><\/div>\n<\/p>\n<p> Even so,  it\u2019s bringing into the spotlight how much foreign (Chinese) money is driving  affordability out of reach of middle and lower income Australia. <em>The Australian Financial Review Weekend <\/em>edition  reports that a parliamentary committee is charged with \u2018<em>finding a solution to the nation\u2019s affordability crisis.\u2019 <\/em><\/p>\n<p> I don\u2019t  like the chances of anything changing much. It\u2019s been a problem that for many  decades now. It blows hotter and colder depending what time you look. There\u2019s a  reason for that. That\u2019s why there\u2019s something familiar about all these kind of headlines.  If you go back to the 1960s, 70s and 80s, you\u2019ll find the same story. It\u2019s seems hard to believe Australia\u2019s finest  policymakers cannot solve this vexing problem. Are they sure they really want  to?
